This application is filed by the applicants Smt Usha and Smt Geeta with a prayer to quash the order dated 7.2.2006 passed by the learned Additional Sessions Judge, Fast Track Court No. 17, Bulandshahar in S.T. No. 865 of 2003 whereby the applicants have been summoned to face the trial for the offences punishable under Sections 304-B and 498-A I.P.C. and Sections ¾ Dowry Prohibition Act in exercise of powers conferred under Section 319 Cr. P. C.
From the perusal of the statement recorded in the court the allegations have been made against the applicants and from the perusal of the impugned order dated 7.2.2007 it appears that there is no illegality or infirmity in the impugned order, therefore, the prayer for quashing the impugned order dated 7.2.2006 is refused.
However, considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicants appear before the court concerned within 30 days from today and apply for bail the same shall be considered and disposed of on the same day in accordance with the provisions of law. If any NBW issued against the applicant the same shall be kept in abeyance only for 30 days only from today.
With the above directions the application is finally disposed of.
