This is a writ petition for a direction to the respondents to take action under section 35 of the U.P. Co-operative Societies Act on the ground that respondent no. 4 has consistently committed default in performing his duties.
We have heard the counsel for the petitioners, the Standing Counsel and Sri Vivek Saran for the respondents.
In the circumstances of the case, it would be appropriate that the petitioners may file a fresh representation before respondent no. 2. In case the representation is filed, it may be decided by the said respondent by a reasoned order at an early date, if possible, within three months from the date of receipt of the representation. The petitioners will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioners.
With these observations, the writ petition is disposed of.
