This is an application for bail moved on behalf of the applicants Raman Sachan and Ved Prakash arraigned in case Crime No.  15 of 2006 under sections 147, 307, 225, 332, 353, 364, 504, 506, I.P.C. and section 7 of Criminal Law Amendment Act, Police station Baror, district Kanpur Dehat.

Heard Sri Arun Kumar Singh, learned counsel for the applicants, learned AGA and have perused the record.

The learned counsel for the applicants submitted that the applicants are witnesses of case Crime No. 13 of 2006 under sections 147, 148, 149, 302 I.P.C. in which Ajai Kumar is an accused and they have been involved in the present case to weaken the said case of murder. The learned counsel urged that none of the police personnel or Ajai Kumar sustained injuries. The learned counsel contended that a mob of 150-200 persons is said to have attacked the police station to get Ajai Kumar released from the police custody. The learned counsel argued that no specific role has been assigned to the applicants. The learned counsel pointed out that co-accused Rajesh Kumar, Shiv Kumar, Lal Man, Devendra Singh and Ravi Shanker have been granted bail by this Court by an order dated 21.6.2006 passed in Criminal Misc. Bail Application No. 11777 of 2006 and the case of the applicants is similar to the said co-accused.

The learned AGA argued that the applicants along with co-accused attacked the police station and forcibly got released the captured accused Ajai Kumar. The learned counsel submitted that the applicants and co-accused mounted assault on police personnel.

I have taken into consideration the submissions advanced on behalf of both the parties.

The mob of 150-200 are said to have attacked the police station. No specific role has been assigned  to the applicants who are witnesses in case Crime No. 13 of 2006 under section 302 I.P.C. There are no injury reports of the police personnel and captured accused Ajai Kumar. Co-accused have been enlarged on bail. In view of these facts, I consider it to be a fit case for bail.

Let the applicants Raman Sachan and Ved Prakash arraigned in case Crime No.  15 of 2006 under sections 147, 307, 225, 332, 353, 364, 504, 506, I.P.C. and section 7 of Criminal Law Amendment Act, Police station Baror, district Kanpur Dehat, be released on bail on their furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
