Appellant Santosh @ Natthu Pandey has preferred this appeal against the judgement and order dated 14.3.2006 passed by Addl. Sessions Judge, F.T.C-2, Chitrakoot in S.T. No. 8 of 2004 whereby the appellant has been found guilty and convicted under Section 8/20 of N.D.P.S. Act and sentenced to under go rigorous imprisonment for seven years and fine has also been imposed on him.
Heard Sri P. V. Singh, learned counsel for the appellant, learned A.G.A. and perused the record.
Learned counsel for the appellant has contended that accused is alleged to have been found in possessionof 20 K.G. Ganja. He has further contended that the quantity of Ganja has been noted as allegedly disclosed by the appellant and in the circumstances, it cannot be said that it was exactly 20 K.G. He has also contended that no weight was taken at the time of the arrest and in this matter other co accused who were also found in possession of Ganja although lesser quantity have been directed to be released on bail.
Considering the facts and circumstances of the case, appellant be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned during the pendency of his appeal. He shall also deposit the amount of fine imposed on him. He shall also give an undertaking that he will not indulge in any criminal or drug-trafficking activity and shall be of good behaviour and in case any complaint is received against him, it shall be open for the court below to report to this Court so that his bail may be cancelled.
