This is an application for bail moved on behalf of the applicant Sonbeer arraigned in case Crime No. 16 of 2006 under section 364-A, I.P.C., Police station Ajitmal district Auraiya.

Heard Sri K.N. Misra, Advocate, holding brief of Sri Akash Mishra, learned counsel for the applicant, learned AGA and have perused the record.

On 18.1.2006 at about 3.30 p.m. informant's son aged about 15 years was abducted while coming to his residence from Badera Inter College. The recovery of the boy was made on 19.1.2006 in a police encounter case.   The applicant was arrested at the spot whereas co-accused managed to escape.

The learned counsel for the applicant submitted that the applicant has been falsely implicated in this case due to enmity of election of village pradhan. The learned counsel urged that applicant's elder brother was a candidate for election of pradhan against the complainant and the complainant was defeated in the election.

The learned AGA argued that recovery of abducted boy was made from the possession of the applicant.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant is not named in the first information report. The applicant was arrested in a police encounter case whereas co-accused managed to escape. The recovery of the abducted boy was made from the spot. There was no demand of ransom. In view of these facts, I consider it to be a fit case for bail.

Let the applicant Sonbeer arraigned in case Crime No. 16 of 2006 under section 364-A, I.P.C., Police station Ajitmal district Auraiya, be  released on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
