Heard learned counsel for the applicant and learned A.G.A.

This application is filed by the applicant Suresh Kumar with a prayer to quash the charge sheet of Case No. 462 of 2004, under Sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, P.S. Kotwali Dehat, District Saharanpur.

From the perusal of the record and the charge sheet it appears that the material collected by the I.O. during investigation prima facie offence is made out against the applicant and there is sufficient material to proceed further, therefore, the prayer for quashing the charge sheet is refused.

Accordingly, this application is dismissed.
