Appellants Chandra Bhushan Singh and Rudra Pal Singh have preferred this appeal against the judgement and order dated 26.4.2006 passed by Special Judge, U.P. Gangster Act, Jhansi in Gangster S.T. No. 63/97 whereby they have been found guilty and convicted under Sections 3 of U.P. Gangster and Antisocial Activities Prevention Act and sentenced to under go rigorous imprisonment up to four years and fine has also been imposed on them.
Heard Sri A. K. Singh, learned counsel for the appellants, learned A.G.A. and perused the record.
The appeal is admitted.
Contention of the learned counsel for the appellants is that appellants are on bail in the matters as alleged against them.
Considering the facts and circumstances of the case, appellants be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned during the pendency of their appeal. They shall deposit half of the the amount of fine as imposed on them and realisation of the balance amount shall remain stayed during pendency of their appeal. They shall also give an undertaking that They will not indulge in any criminal or anti social activity and shall be of good behaviour and in case any complaint is received against them, it shall be open for the court below to report to this Court so that their bail may be cancelled.
