Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicants that in the present case the charge sheet was submitted against the 5 persons, but without recording any other evidence the I.O. has submitted charge sheet against the applicants also. It is further contended that there is no evidence against the applicant to show that they have committed the alleged offence.
Learned A.G.A. prays for and is granted 4 weeks' time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. it is directed that the attendance of the applicants shall be noted in the trial court through their counsel till the next date of listing, but the proceedings of the trial shall continue.
