This is an application for bail moved on behalf of the applicant Gauri Shanker who is being tried in S.T. No. 395 of 2005 under sections 417, 418, 420, 506 I.P.C. read with section 3 (i) (x) S.C./S.T. Act, Police station Deoriya, district Pilibhit.
Heard Sri B.D. Sharma, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant did not appear before the trial court on 25.1.2005 due to sudden illness and non-bailable warrants were issued against him. The learned counsel urged that the applicant appeared before the court on 23.3.2006 and an application was moved for cancellation of warrants.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant remained absent from trial on two dates, i.e., 25.1.2006 and 28.2.2006. The applicant had been attending the trial before the said dates. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Gauri Shanker involved in complaint case in S.T. No. 395 of 2005 under sections 417, 418, 420, 506 I.P.C. read with section 3 (i) (x) S.C./S.T. Act, Police station Deoriya, district Pilibhit, be released on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
