Heard Sri Amit Kumar Srivastava and Sri R. K. Khanna, learned counsel for the appellant, learned A.G.A. and perused the record.
Appellant Prem Pal has preferred this appeal against the judgement and order dated 21.1.2006 passed by learned Addl. Sessions Judge, Chandusi, Moradabad in S.T. No. 613 of 2004 whereby he has been found guilty and convicted under Sections 307 IPC and sentenced to under go rigorous imprisonment for a period of five years and fine has also been imposed on him.
Learned counsel for the appellant has contended that appellant has been falsely implicated on account of enmity and there were litigation pending with the injured. He has also contended that although the appellant is alleged to have fired at the injured but no internal damage has been caused and he is in jail since January 2006.
Considering the facts and circumstances of the case, appellant be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned during the pendency of his appeal. He shall also deposit the amount of fine as imposed on him. He shall also give an undertaking that he will not indulge in any criminal or anti social activity and shall be of good behaviour and in case any complaint is received against him, it shall be open for the court below to report to this Court so that his bail may be cancelled.
