Heard learned counsel for the applicant and learned A.G.A.
It is contended by the learned counsel for the applicant that in the present case the applicants and the opposite party no. 2 are husband and wife and without any cogent reasons the notice under Section 111 Cr. P. C. has been issued by the learned City Magistrate, Allahabad.
Learned A.G.A. prays for and is granted 4 weeks' time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. the further proceedings in Criminal Case No. Nil of 2006 pending in the court of learned Cityl Magistrate, Allahabad shall remain stayed till the next date of listing.
