Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicants that in the present case the charge sheet has been submitted agains the applicants is a dispute between the husband and wife. The opposite party no. 2 is the wife of applicant no, 1.It is further contended that after submission of the charge sheet the parties has come into compromise and the deed of the compromise has been filed in the court concerned.
Learned A.G.A. prays for and is granted 4 weeks' time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. it is directed that the applicant no. 3 shall deposit a sum of Rs. 5,000/- in the court of learned .J.M. 1st , Bareilly. The amount so deposited shall be handed over to the opposite party no. 2. In case the aforesaid amount is deposited the further proceedings in Criminal Case No. 615 of 200 pending in the court of learned .J.M. 1St, Bareilly, shall remain stayed till the next date of listing.
