Heard learned counsel for the applicant and learned A.G.A.
It is contended by the learned counsel for the applicant that NBW has been issued against the applicant and proceedings under Sections 82 and 83 Cr. P. C. have also been initiated against applicant Vijay Raj Jain in case crime No. 1182 of 2005, under Sections 307, 504 and 506 I.P.C., P.S. Mundha Pande, District Moradabad.
It is further contended that the applicant wants to appear before the court concerned , but due to issuance of NBW he is not being permitted by the police to appear before the court concerned.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that the applicant shall appear before the court concerned within 30 days from today till then the NBW issued against him and the proceedings initiated against him under Sections 82 and 83 Cr. P. C. shall be kept in abeyance.
With the above directions the application is finally disposed of.
