Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicants that without taking sanction from the State Government the learned Magistrate has taken the cognizance under Section 153-A I.P.C. also.
Learned A.G.A. prays for and is granted 4 weeks' time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. it is directed that no coercive measure shall be taken against the applicants in Criminal Case No. 1147 of 2003 pending in the court of learned C.J.M., Rampur shall remain stayed till the next date of listing.
