Heard learned counsel for the applicant and learned A.G.A.

It is contended by the learned counsel for the applicant that the date of receiving the notice by the applicant has not been mentioned in the complaint.

Issue notice to opposite party no. 2 returnable within a period of four weeks

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and learned A.G.A.   the further proceedings in Criminal Complaint Case No. 5338 of 2005, under Section 138 of the Negotiable Instrument Act  pending in the court of learned Additional A.C.J.M., 8th, Court No. 8, Bareilly  shall remain stayed till the next date of listing.

List  after 4 weeks for orders.
