The petitioner had earlier come up against the order granting the maintenance to Smt Satya Devi, which order was passed on 17.8.2005. The said writ petition was dismissed by me on the ground of alternative remedy available to the petitioner by filing a civil suit in order to dislodge the factum of marriage between the petitioner and Smt.Satya Devi.The present writ petition has been filed against the order dated 24.2.2006, dismissing the appeal/ statutory petition of the petitioner by the Chief Army Staff on the basis of finding that the petitioner is the husband of Smt.Satya Devi.
In view of the order passed by me on 26.4.2006 in writ petition no.22636 of 2006 , it is provided that in case the petitioner succeeds in the civil suit and findings with regard to the marriage of the petitioner are reversed then in that event, the petitioner will have an opportunity to apply for review of the order dated 24.2.2006 impugned in the present writ petition. I do not find any reason to interfere at this stage.
The petition is dismissed with the aforesaid observations.
