Heard learned counsel for the applicant and learned A.G.A.

This application is filed by  applicant Om Prakash with a prayer to quash the order dated 22.7.2005 passed by the learned Chief Judicial Magistrate, Jalaun at Orai by which the learned Magistrate has taken the cognizance against the applicant and summoned the applicant to face the trial for the offences punishable under Sections 376, 354, 504, 506 and 452 I.P.C.

From the perusal of the order dated 22.7.2005 it appears that the learned Magistrate has taken the cognizance on the basis of material collected by the I.O. during the allegation and there is sufficient material to proceed further. There is no illegality in the impugned order dated 22.7.2007, therefore, the prayer for quashing the impugned order  is refused.

 

However, considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case  the applicant  appears before the court concerned within 30 days from today and   applies for bail the same shall be considered and disposed of expeditiously , if possible,  on the same day in accordance with the provisions of law. If any NBW issued against the applicant the same shall be kept in abeyance only for 30 days   from today.

With the above directions the application is finally disposed of.
