This is an  application for bail moved on behalf of the applicant Radhey Shyam alias Dabboo Singh   indicted in case crime No. 269  of 2006  under section  3 (1) U.P. Gangsters Act and Anti Social Activities (Prevention) Act P.S. Kotwali Sadar  District Jaunpur .

Heard Shri Kailash Nath Pathak and Shri Ashok Kumar Gupta, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that in the gang chart criminal history of five cases has been shown against the applicant. The learned counsel pointed out that applicant is on bail in all the five cases. The learned counsel submitted that applicant has been falsely implicated due to political rivalry.

The learned A.G.A. argued that applicant is a man of criminal antecedents and in case he is enlarged on bail he will indulge in other criminal activities.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant is on bail in all the five cases shown in the gang chart. The applicant is not an accused in case crime no. 819 of 2003 under section 302 I.P.C. and section 7 of Criminal Amendment Act.In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Radhey Shyam alias Dabboo Singh   indicted in case crime No. 269  of 2006  under section  3 (1) U.P. Gangsters Act and Anti Social Activities (Prevention) Act P.S. Kotwali Sadar  District Jaunpur , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
