This application has been filed by applicants Shamshad and Rohtash with a prayer to quash the proceedings of Case No. 15 of 1992, under Sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, pending in the court of Special Judge, Gangsters Act, Meerut.
From the perusal of the record, it appears that on the basis of the 2 cases the F.I.R. of this case has been lodged against the applicants and the proceedings are pending in the court since 1991 and no witnesses has been turned up till now, therefore, the proceedings may be quashed.
Learned A.G.A. opposed this contention by submitting that it is not a proper ground to quash the proceedings.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicants, I am of the view that the grounds taken by the learned counsel for the applicants for quashing the proceedings is not proper, therefore, the prayer for quashing the proceedings is refused.
However, considering the facts that the proceedings of the trial of this case is being delayed, the Special Judge, Gangsters Act, Meerut is directed to expedite the proceedings of the trail and no unnecessary adjournment shall be granted. The proceedings shall be concluded expeditiously, if possible within a period of 6 months from the date of presentation of certified copy of this order.
With the above directions the application is finally disposed of.
