It is contended on behalf of the applicant that marriage in between the applicant and deceased was solemnized about 20 years ago. In such circumstances, dowry could not be demanded. It is further contended that there is common allegations against all the accused persons namely Brij Kishor, Sarju Prasad and Shyam Sundar. The bail application of co-accused Sarju Prasad Pandey and Shyam Sundar had already been allowed by Sessions Judge, Basti vide order 10.5.2006.
After considering the facts and circumstances of the case, his bail application is liable to be allowed.
The bail application is allowed. Let applicant Brij Kishore involved in case Crime No.88 of 2006, under Sections 498-A and 306 I.P.C. read with Section 3 of Protection of Woman from Domestic Violence Act, Police Station Pikolia, District Basti be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the concerned Court.
