Heard learned counsel for the applicant and learned A.G.A.
This application is filed by the applicant Kuldeepak Goel with a prayer that his bail application may be disposed of by the courts below expeditiously ,if possible on the same day in case crime no. 277 of 2005, under Sections 420, 467, 468, 471and 506 I.P.C. P.S. Nazirabad, District Kanpur Nagar.
It is contended by the learned counsel for the applicant that the applicant is peace loving and law abiding person. He undertakes that he shall co-operate with the proceedings of the trial and he shall not tamper with the evidence. It is further contended that the applicant wants to appear before the court concerned, but there is reasonable apprehension in his mind that in case he appears before the court concerned and applies for bail his bail application shall not be considered and disposed of expeditiously or on the same day, so a suitable direction may be issued to the courts below that the bail application of the applicant may be considered and disposed of expeditiously if possible on the same day.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail his bail application shall be considered and disposed of expeditiously if possible on the same day. If any N.B.W. issued against the applicant the same shall be kept in abeyance for a period of 30 days only from today.
With the above direction the application is finally disposed of.
