This application is filed by the applicant Ravindra Singh with a prayer to quash the order dated 27.3.2006 passed by the learned Additional Sessions Judge, Court No. 10th, Aligarh in S.T. No. 666 of 2003 by which he has been summoned to face the trial under Sections 147, 148, 302 I.P.C. read with Section 149 I.P.C. in exercise of powers conferred under Section 319 Cr. P. C.
From the perusal of the record and impugned order dated 27.3.2006 it appears that on the basis of examination-in-chief of witness Ram Murty Singh the involvement of the applicant in the commission of the alleged offence is established. The trial court did not commit any error in passing the order dated 27.3.2006, therefore, the prayer for quashing the impugned order dated 27.3.2006 is refused.
However, considering the facts and circumstances of the case, it is directed that in case the applicant appears before the court concerned within 20 days from today and applies for bail the same shall be considered and disposed of expeditiously, if possible, on the same day in accordance with the provisions of law. If any NBW issued against the applicant the same shall be kept in abeyance only for 20 days from today.
With the above directions the application is finally disposed of.
