Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicants that on the basis of the charge sheet submitted by the I.O. the applicants have been summoned to face the trial. The application under Section 156(3) Cr. P. c. filed by the opposite party no. 2. the same was allowed and thereafter, the F.I.R. of this case was registered and after investigation the charge sheet has been submitted against the applicants. The application under Section 156 (3) Cr. P. C. was moved by the opposite party no. 2 in a counter blast of the F.I.R. of case crime no. 288 of 2006, under Section 419 and 420 I.P.C. lodged by applicant Manoj Kumar Rai against the opposite party no. 2.
Learned A.G.A. prays for and is granted 4 weeks time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and learned A.G.A. the further proceedings in Criminal Complaint Case No. 8 of 2005, pending in the court of learned Judicial Magistrate, Gorakhpur shall remain stayed till the next date of listing.
List after 4 weeks for orders.
