Mrs. Kamlesh Sadh v. U.P. State Industrial Industrial Development Corp. &Ors. - WRIT - C No. 37207 of 2006 RD-AH 11716 (18 July 2006)
Hon'ble Yatindra Singh,J.
The petitioners are permitted to implead respondents no. 4 and 5.
According to the petitioners, Uttar Pradesh State Industrial Development Corporation Ltd. ( UPSIDC) allotted a plot in favour of respondent no. 4 and thereafter executed a lease deed in its favour. Respondent no. 4 has decided to transfer this plot to the petitioners, but as no action is being taken by the UPSIDC in this regard, the present writ petition has been filed.
We have heard counsel for the petitioners, the Standing counsel and Sri S.K. Misra for the respondents.
In the circumstances of the case, the petitioners may file a fresh representation before respondent no. 5. In case the representation is filed, it may be decided by the respondent no. 5 by a reasoned order at an early date, if possible, within three months from the date of receipt of the representation. The petitioners will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioners. The respondent no. 5 while passing any order on the petitioners' representation will also give an opportunity to respondent no. 4.
With these observations the writ petition is disposed of.
