This is an application for bail moved on behalf of the applicant Deepak Kumar Jain indicted in case crime No. 64 of 2006 under sections 363, 366 and 368 I.P.C. P.S. Quarsi District Aligarh.
Heard Shri V.M. Zaidi holding brief of Shri Aklank Jain,learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant is not named in the First Information Report. The learned counsel argued that the witnesses have stated that the applicant's car was used for taking away the girl by the main accused Vyas.
The learned A.G.A. argued that girl is yet untraceable. The learned counsel submitted that co-accused Vyas had talked to the applicant on his mobile on date of incident.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant is not named in the First Information Report amongst the accused person who took away the girl. The applicant is said to have assisted the main accused Vyas in taking away the girl by providing his car. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Deepak Kumar Jain indicted in case crime No. 64 of 2006 under sections 363, 366 and 368 I.P.C. P.S. Quarsi District Aligarh , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
