Heard Sri C.S.Srivastava, learned counsel for the petitioners and Sri Udai Pratap Singh holding brief of Sri B.N.Singh, learned counsel on behalf of respondent no.2 and learned Standing counsel appearing on behalf of respondent no.1.
It is contended by learned counsel for the petitioners that the controversy with respect to pay scale of class III and IV employees employed under respondent no.2 has since been decided by this court in Writ Petition No.7942 of 1994 and Writ Petition No.16910 of 1994 by the judgment and order dated 24.4.2000. The aforesaid judgments have been confirmed in special appeal as also by the Hon'ble Supreme Court. The true copies of the aforesaid judgments have been filed as annexures to the writ petition. Learned counsel for the University does not dispute this contention. From a perusal of the writ petition it appears that the petitioners are working as daily wage for more than eight years.
In view of admitted position between the parties this writ petition is also decided on the same terms and conditions as in Writ Petition No. 7942 of 1994 decided on 24.4.2000.
The writ petition is disposed of as above. No order is passed as to costs.
