This is an application for bail moved on behalf of the applicant Jagpal Singh indicted in case crime No. 199 of 2005 under sections 302, 201 I.P.C. P.S. Shahi District Bareilly .
Heard Dr. Arun Srivastava, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the only incriminating circumstance against the applicant is that he was seen standing near the victims by the witnesses in the evening at 6-7 P.M.
The learned A.G.A. argued that applicant is named in the First Information Report and there was dispute over partition of ancestral property. The learned counsel urged that applicant used to threaten eliminate complainant's progeny. The learned counsel urged that death was caused due to asphyxia as a result of ante mortem strangulation.
I have taken into consideration the submissions advanced on behalf of both the parties
The only evidence against the applicant is that he was seen standing near the victims on 11.6.2005 at about 6-7 P.M. Looking to the nature of circumstantial evidence, I consider it to be a fit case for bail.
Let the applicant Jagpal Singh indicted in case crime No. 199 of 2005 under sections 302, 201 I.P.C. P.S. Shahi District Bareilly , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
