Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicant that in the present case the F.I.R. was lodged by the opposite party no. 2 in which final report has been submitted. Against that final report the protest petition was filed and the statement of the complainant and the witnesses were recorded under Sections 200 and 202 Cr. P. C. After considering the same the learned Magistrate rejected the final report and summoned the applicants to face the trial. The allegations made against the applicants are false and frivolous and all these allegations are in a counter blast of the F.I.R. which was lodged by the side of the applicants. In that incident Mahruf Ahmad has receive many injuries.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. the further proceedings in Criminal Case No. 83/11 of 2004 pending in the court of learned A.C.J.M., Court No. 9, Basti shall remain stayed till the next date of listing.
List after 4 weeks for orders.
