This application has been filed by applicants Mejor Singh, Gurmej Singh, Smt. Jaswant Kaur and Smt Manjeet Kaur with a prayer to quash the proceedings of Case No. 3009 of 2005, under Sections147, 149, 323, 343, 494 I.P.C., pending in the court of A.C.J.M., Pilibhit.
From the perusal of the record, it appears that on the basis of the complaint and the statement of the witnesses recorded under Sections 200 and 202 Cr. P. C. the learned Magistrate has taken the cognizance and summoned the applicants to face the trial and from perusal of the order dated 20.2.1998 by which the cognizance has been taken against the applicants and they have been summoned to face the trial, it appears that it is a reasoned order and after considering the nature of allegation the order has been passed. It is perfect order. It does not require any interference by this court, therefore, the prayer for quashing the proceedings is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicants appear before the court concerned within 30 days from today and apply for bail their bail application shall be considered and disposed of expeditiously if possible on the same day. If any N.B.W. issued against the applicants the same shall be kept in abeyance for a period of 30 days only from today.
With the above direction the application is finally disposed of.
