Sri Ashok Khare, learned Senior Counsel appearing for the appellants contended that all the appellants were appointed after due selection. It is submitted that 17 posts of Class-IV Employees were advertised by advertisement dated 15.5.1998 and after due selection, i.e., written test and interview held on 27.6.1998 a select list of 39 candidates was prepared by the Selection Committee. Pursuant thereto they were appointed against Class-IV posts on various dates. It has further been claimed that the petitioners-appellants are working almost about six years and now their services have been terminated without affording any opportunity or show cause. It is further contended that after termination of the services of the petitioners-appellants, the District Judge has made several appointments against the post of Malies and Chaukidars without advertisement and without undertaking process of selection and those appointees are being allowed to continue to work against the post held by the petitioners-appellants. He further referred to the statements made in paras 7 and 8 of the writ petition and also in para-7 of the counter affidavit.
Sri K.R.Sirohi, learned counsel appears for respondents no.2 and 3. Learned Standing Counsel appears for respondent no.1.
Having heard learned counsel for the parties and considering the submissions and looking to the facts of the case, it is provided that until further orders of this Court, the respondents shall not make any appointment pursuant to the interview which is scheduled to be held on 23.7.2006.
