Hon. S.P. Mehrotra, J.

Sri Niraj Agarwal, learned counsel for the defendants -appellants states that the defendants-appellants do not want to press the Second Appeal any further, and the same may be dismissed as not pressed.

In view of the statement made by Sri Niraj Agarwal, learned counsel for the defendants -appellants, the Second Appeal is dismissed as not pressed.

The interim order dated 26.7.1983, as confirmed by the order dated 20.1.1984, is hereby vacated.

It is made clear that no liberty is being given  to the defendants-appellants to file a fresh Second Appeal in respect of the  same cause of action.
