Respondent no. 4 was allotted the plot in question by the NOIDA. According to the petitioners the respondent no.4 had executed an agreement for sale in favour of respondent no.3 and respondent no.3 had executed an agreement for sale in favour of the petitioners. Now the petitioners have filed the present writ petition for a direction to the NOIDA to transfer the plot in question in their favour.
We have heard the counsel for the petitioners, Mr. Anurag Khanna , Ms. Swati Agarwal and the Standing Counsel for the respondents.
It is not disputed that the allotment is in favour of respondent no.4. The petitioners at the most have got an agreement for sale in their favour . This does not entitle them to get any relief from this Court. The petitioners may, if they are so advised, file a suit for specific performance of contract.
With these observations the writ petition is dismissed
