Heard Sri H.P. Dube, learned counsel for the petitioner and Sri Samir Sharma, learned counsel appearing for respondent-Corporation and the learned Standing Counsel appearing for respondent Nos. 1,2 and 3.
This writ petition has been filed seeking a direction to the respondent Nos. 2 and 3 to restrain respondent No. 4 from plying their vehicles on the route on which the petitioner has permit namely Auraiya-Tirwa via Dibiapur.
As no person is permitted to ply his vehicle without having a valid permit under the Motor Vehicles Act, 1988, it is not permissible for any person including the U.P. State Road Transport Corporation to ply the vehicles on the route unless it has a valid permit to operate on the said route. However, there may be certain vehicles like Jugads etc., which may not require a permit.
We, therefore, dispose of this writ petition finally with the direction to respondent Nos. 2 and 3 to ensure that no person should ply the vehicle without the permit on the route involved in this writ petition.
The petitioner shall submit a certified copy of this order before the respondents concerned within a week from today.
