Heard learned counsel for the petitioner.

In pursuance to the order of the court below dated 19.7.2005 (Annexure-1 to the writ petition), a trust property under the receivership was directed to be given on lease for a further period of five years after observance of certain formalities enumerated in the said order. The receiver, in compliance of the directions of the court had forwarded the tenders received from several bidders and the tender of respondent No.2 had been accepted and approved. That acceptance of tender was a subject of challenge before the court below by the petitioner, who is a third party in the suit. He has absolutely no interest in the trust property. The court below, by the impugned order, found that after going through the required formalities as directed by the court, the tenders were forwarded and proposal was made to grant a lease to respondent No. 2 by respondent No. 3. The court has found that there is absolutely no illegality in acceptance and approval of tender given by respondent No.2 and the court has accepted and approved it. Since the court below has examined all these aspects and the objections raised by the petitioner and then only has found no strength therein.

This court sitting in extra ordinary jurisdiction of writ is not supposed to further investigate in the matter and pass any order reversing such acceptance of tenders. The petitioner does not appear to have any locus also in the present matter.

The petition, having no force, is hereby dismissed.
