This application is filed by applicant Mahatama Bharti with a prayer to quash the charge sheet No. 79 of 2006 in case crime no. 263 of 2006, under Sections3/7 E.C. Act, P.S. Chopan, district Sonebhadra, pending in the court of C.J.M., Sonebhadra vide case no. 4023 of 2006.
From the perusal of the record and the impugned charge sheet it appears that on the basis of the material collected by the the I.O. prima facie offence is made out and there is sufficient material to proceed further, therefore, the prayer for quashing the charge sheet is refused.
However, considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail the same shall be considered and disposed of expeditiously , if possible, on the same day in accordance with the provisions of law. No coercive steps shall be taken against the applicants for a period of 30 days only from today.
With the above direction the application is finally disposed of.
