Heard learned counsel for the petitioners.

The petitioners' application for temporary injunction has been rejected by the trial court as well as the appellate court.

The petitioners claim right over a particular passage which finds its proposal in the sale-deed executed in their favour by the other party. If there is proposal of such pathway which was not in existence at the time of transfer of the property through that sale-deed, no right to have a pathway can be said to have accrued in favour of the petitioners on account of that reference.

This petition appears to be wholly misconceived and is hereby dismissed.
