Heard learned counsel for the applicant and learned A.G.A.
It is contended by the learned counsel for the applicant that in the present case a complaint has been filed by the opposite party no. 3 in respect of 3 cheques , but all the cheques were not issued by the applicant to the opposite party no. 2. It is a composite complaint, which is not permissible in the eyes of law.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. the further proceedings in Criminal Complaint Case No. 1960 of 2004, under Section 138 of the Negotiable Instrument Act, pending in the court of learned Additional Chief Judicial Magistrate, Court No. 2, Allahabad shall remain stayed till the next date of listing.
