Heard learned counsel for the applicant and learned A.G.A.
It is contended by the learned counsel for the applicant that in the present case the applicant has been summoned to face the trial on the basis of the complaint filed by the opposite party o. 2. According to the prosecution version itself nothing incriminating was recovered from the place of occurrence to show that the applicant was consuming the electricity.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. the further proceedings in Criminal Complaint Case No. 14 of 2005, under Section 135 of the Electricity Act, pending in the court of learned Special Judge, Electricity Act, Azamgarh shall remain stayed till the next date of listing.
