Heard learned counsel for the petitioner.

On petitioner's application for temporary injunction, the trial court has directed issuance of notice fixing a date for the disposal. This order is under challenge. I do not find any infirmity in the order, which is wholly in accordance with the provisions of Order 39 Rule 3 C.P.C.

This petition is misconceived and is hereby dismissed.
