Heard learned counsel for the applicant and learned A.G.A.
This application has been filed by the applicant Anurag Tyagi with a prayer to quash the NBW issued against the applicant in Case No. 1927 of 2003( New Number of 1244 of 2005), State Vs. Bhoop Singh and others pending in the court of Special C.J.M. Meerut.
From the perusal of the record it appears that the applicant was not appearing in the court that is why the NBW has been issued against the applicant. There is no illegality in issuing the NBW against the applicant, therefore, the prayer for quashing the NBW is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicants appear before the court concerned within 20 days from today and apply for bail their bail application shall be considered and disposed of expeditiously. If any N.B.W. issued against the applicants the same shall be kept in abeyance for a period of 20 days only from today.
With the above direction the application is finally disposed of.
