Heard learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed as a public interest litigation by the petitioner claiming to be a social worker.
The petitioner has prayed for a mandamus commanding the respondents to make the transfers & postings of Inspectors, Sub-Inspectors, Head constable and constables as well as the ministerial staff in accordance with provision of paragraph 520 to 524 of the U.P. Police Regulations. A reference of Government Orders laying down transfer policy for certain police personnels has also been mentioned.
From the averments made in the writ petition we are not satisfied that the petitioner has sufficient locus to file this writ petition as a P.I.L. The policy pertaining to transfer of police personnel has been made from time to time by the authority competent. The P.I.L. in service matters has been looked with disfavour by several judgements of the Apex Court, in this regard the learned Standing Counsel has rightly placed reliance on paragraph 8 of the judgement of the Apex Court reported in AIR 2005 Supreme Court 2755 Gurpal Singh vs. State of Punjab and others.
Following the aforesaid judgment, this writ petition cannot be entertained as a public interest litigation and it is dismissed.
