Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicants that on the basis of the complaint filed by the opposite party no. 2 Keval Pati wife of applicant no. Ram Preeti the applicants have been summoned to face the trial. The complaint is base on false and frivolous allegation. There is dispute between the husband and the wife. The The opposite party no. 2 is the wife of applicant no. 3.It is further contended that some positive efforts should be made to reconcile the matrimonial relations of the husband and wife.
Learned A.G.A. prays for and is granted 4 weeks time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. it directed that the applicant no. 1 shall deposit a sum of Rs. 8000/- in the court of learned 4th Additional Civil Judge (J.D.)/ Judicial Magistrate, Court No. 17, Basti. The amount so deposited shall be handed over to opposite party no. 2 Smt Keval Pati. In case the aforesaid amount is deposited, the further proceedings in Criminal Case No.955 of 2004, pending in the court of learned 4th Additional Civil Judge (J.D.)/ Judicial Magistrate, Court No. 17, Basti. shall remain stayed till the next date of listing.
