Heard Sri Anurag Khanna, learned counsel for the applicants, Sri G.S. Hajela, learned counsel for the opposite party no.2, learned A.G.A. and perused the record.
Application under Section 482 Cr.P.C. has been filed to quash the proceedings of Case No. 66 of 2005 under Sections 120-B, 420, 467, 468, 471 IPC read with Section13(2) and 13(1)(d) of the Prevention of Corruption Act, 1988, P.S. CBI/SPPPE Dehradun, pending in the Court of Special Judge, C.B.I., Ghaziabad. However, learned counsel for the applicants has prayed that learned Trial Court be directed to decide the bail application of the applicants expeditiously.
Application is finally disposed of with the direction that if the applicants surrender within 15 days from today and pray for their bail, the same shall be heard and decided by the Court concerned expeditiously keeping in view of the Judgement of Amrawati Vs. State, 2004, ALR. During these period of 15 days execution of non bailable warrant dated 19.12.2005 shall be kept in abeyance.
