Heard learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the respondents 1 to 3 as well as Sri V. K. Singh, learned counsel for contesting respondent no. 4.
The petitioner aggrieved by the order passed by the Tehsildar/Assistant Collector dated 28th October, 2002, by which the petitioner was directed to be evicted from the land in dispute in his possession, who has been held to be un-authorised occupant, preferred a revision before the Additional Collector. The revisional Court by the impugned order dated 19th January, 2006 dismissed the revision filed by the petitioner against the order dated 28th October, 2002, passed under Section 122-B (4-A) of U.P. Zamindari Abolition and Land Reforms Act, 1950 (In short 'the Act').
I have gone through the order passed by the Tehsildar as well as order passed by the Additional Collector. I do not find any error, nor any error has been pointed out by learned counsel for the petitioner, which may warrant any interference by this court in exercise of jurisdiction under Article 226 of the Constitution of India.
In view of what has been stated above, this writ petition has no force and is accordingly dismissed. However, there will be no order as to costs.
