Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicants that in respect of two cheques one complaint has been filed. It is a composite complaint which is not permissible in the eye of law. It is further contended that no notice has been received by the applicant even the date of notice has not been mentioned by the opposite party no. 2. The complaint is based on the false and frivolous allegations.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and learned A.G.A. the further proceedings in Criminal Complaint Case No. 1280 of 2004, under Section 138 of the N.I. Act, pending in the court of learned A.C.M.M. 3Rd, Kanpur Nagar shall remain stayed till the next date of listing.
