Heard Shri U.K. Saxena counsel for the petitioner and learned standing counsel.
It is submitted by the counsel for the petitioner that the sale was made in pursuance of recovery proceedings under the Recovery of Debts to Banks and Financial Institutions Act 1993 and the duty payable is under Article 18 of Schedule I-B of the Indian Stamp Act and not on the market value.
Standing counsel represents respondent nos. 1 to 5. He prays for and is granted three weeks time to file counter affidavit. Petitioner will have three weeks thereafter to file rejoinder affidavit.
Until further orders no recovery in pursuance of the impugned orders dated 11.2.2005 of Commissioner, Meerut Division, Meerut and order dated 17.3.2004 of Additional Collector, (Finance & Revenue), Ghaziabad shall be made against the petitioner.
