Heard learned counsel for the applicant and learned A.G.A.
It is contended by the learned counsel for the applicants that there is dispute between the husband and wife. The applicant No. 1 is the husband of the daughter of the opposite party no. 2 . The allegations made against the applicants are false and frivolous. It is further contended that some positive efforts should be made to reconcile the matrimonial relations of the husband and wife.
Learned A.G.A. prays for and is granted 4 weeks time to file counter affidavit.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and learned A.G.A. it directed that the applicant No. 1 shall deposit a sum of Rs. 10,000/- in the court of learned 10th Additional Chief Judicial Magistrate, Agra. The amount so deposited shall be handed over to opposite party no. 2. In case the aforesaid amount is deposited, the further proceedings in Criminal Case No.114 of 2006, pending in the court of learned 10th Additional Chief Judicial Magistrate, Agra shall remain stayed till the next date of listing.
List after 4 weeks for orders.
