Heard learned counsel for the parties land also perused the materials on record.

Learned counsel for the petitioner has stated across the bar that controversy involved in this petition has already been decided by means of judgment-dated 12.12.2005 passed in Civil Misc. Writ Petition no. 16614 of 2005 Anurag Kumar Tiwari v. State of U.P. through Principal Secretary, Uchcha Shiksha Anubhag-II Government of U.P. Lucknow and others.

I have been taken through the judgment rendered in the aforestated writ petition and in my considered view, this petition can well be disposed of in terms of the decision rendered in the aforestated writ petition.

In the result, the petition is accordingly disposed of in terms of decision rendered in Civil Misc. Writ Petition No. 16614 of 2005 Anurag Kumar Tiwari v. State of U.P. through Principal Secretary, Uchcha Shiksha Anubhag-II Government of U.P. Lucknow and others.
