This is an  application for bail moved on behalf of the applicant Naval Kishore Sharma   indicted in case crime No. 675  of 2006  under section 306  I.P.C. P.S. Pakbara  District Moradabad .

Heard Shri Amit Singh, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that the victim was married to applicant's brother about eleven years before and she committed suicide by setting herself to fire. The learned counsel urged that general allegations of demand of dowry have been made against all the accused persons. The learned counsel pointed out that cash of Rs. 90,000/- was paid by the informant to co-accused Vipin Kumar, the husband of  deceased.

The learned A.G.A. submitted that informant's daughter was set on fire by the applicant and co-accused for demand of car or cash of Rs. two lac.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant is the younger brother-in-law of deceased. The marriage of victim had taken place about eleven years before the incident. General allegations of demand of car or cash of Rs. two lac have been made against all the accused persons including the applicant. There is no specific allegation of cruelty against the applicant In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Naval Kishore Sharma   indicted in case crime No. 675  of 2006  under section 306  I.P.C. P.S. Pakbara  District Moradabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
