Rajendra Singh Bhadauria v. State Of U.P. Thru' Principal Secy. Others - PUBLIC INTEREST LITIGATION (PIL) No. 39218 of 2006 RD-AH 12202 (25 July 2006)
Hon'ble Ajoy Nath Ray, CJ
Hon'ble Ashok Bhushan,J
Heard learned counsel for the petitioner.
This writ petition has been filed as a public interest litigation praying for a mandamus directing the District Magistrate, Auraiya to get the matter investigated of preparation of list of Antyodaya and B.P.L. ration card of villages Raipur, Dharmangadpur, Nandpur.
The complaint of the writ petitioner is that the list of Antyodaya and B.P.L. ration card has not been correctly prepared with regard to above mentioned three villages. Several irregularities have been committed. The preparation of Antyodaya and B.P.L. ration card and implementation of other schemes of the State Government with regard to villages in question are the matters for the authorities entrusted under the said scheme to implement and correct the error if any. We are satisfied that this is not a fit case for being entertained as a public interest litigation with regard to correction of the list with regard to three villages mentioned above. In P.I.L. this Court cannot monitor or supervise the various schemes of the State Government. Implementing the State Government's schemes is the responsibility of the administration.
It is open for the petitioner to bring into the notice of the administrative authorities who are entrusted to correct or remove the errors and irregularities with regard to implementation of the Government's schemes. We have no doubt that if attention of the authorities is invited, they may look into the irregularities and some decision may be taken.
With the above observation, the petition is dismissed.
